New Jersey Transit Corp. withdrew its sovereign-immunity defense in Railware Inc.’s patent suit accusing it of infringing patents covering railworker-safety technology after the US Supreme Court ruled the agency isn’t an arm of New Jersey.

NJ Transit withdrew the portion of its motion to dismiss that was based on 11th Amendment immunity. In a letter filed March 13 in the US District Court for the Southern District of New York, it said it “maintains the remaining arguments” in its bid to toss Railware’s infringement allegations for failing to adequately state claims.
